Legislative Update -- $100 Million in Grants for Septic System Repair/Replacement Passes Key Milestone

Dear Colleague,

We have good news to report on our legislative efforts. The Senate Environment and Public Works Committee has completed its markup of S. 3591 - America's Water Infrastructure Act of 2020 (AWIA 2020). Because of your association's efforts, legislation which could greatly increase funding for onsite systems repairs and replacement has been included in the bill.

The language that was included in AWIA 2020 was taken directly from S. 3274, a Senate bill introduced by Sen. Corey Booker (D-NJ), and also sponsored by Shelly Moore Capito (R-WV) and Doug Jones (D-AL). NOWRA worked closely with Sen. Booker's office in developing this legislation. The legislation would establish a grant program at EPA to help low income Americans repair and replace failing onsite systems. It authorizes up to $50 million in grants for FY2021 and FY2022. If passed as written, EPA would distribute the funds to qualified nonprofit organizations, which would in turn issue grants to eligible applicants.

This is an especially important milestone. AWIA 2020 is almost certain to be passed this year, so being in the Senate's version of the bill is a critical step to making this program a reality.

However, our work is not done and we need your help. There is a companion to Senator Booker's bill, H.R. 5856, which has been introduced in the House of Representatives by Reps. Terri Sewell )D-AL) and Brian Babin (R-TX). It's important that we build support for this legislation. Here's why:

  *   The House of Representatives' version of AWIA 2020 will be much narrower than the Senate version, and we do not expect the House version to include our legislation.
  *   This means that the House and Senate versions of AWIA 2020 will need to be merged.
  *   The more support we have for H.R. 5856 in the House, the greater the chance the grant program will remain in the final bill the President signs.
