Revised DEM Stormwater Construction Permit and Water Quality Certification Application



Over the past several months, RIDEM’s Office of Water Resources (OWR) has been working to update requirements for Water Quality Certifications to be consistent with the new “Clean Water Act Section 401 Certification Rule (40 CFR Part 121) which went into effect on September 11, 2020. This effort required changes to DEM’s application requirements for Water Quality Certifications needed as part of a Federal permit. In the process of incorporating these new requirements, OWR took the opportunity to make additional revisions to its Application for Stormwater Construction Permit and Water Quality Certification to reflect other process improvements. This new form is now accessible on DEM’s website and should be used for any new or modification applications to OWR.

Summary of Changes:



General Changes

  1.  The “Start” tab was removed. This tab provided outdated and unnecessary information.
  2.  The “Notice of Start of Construction” and “Notice of Termination” tabs were removed. These forms are now available as fillable pdfs on the Stormwater Construction Permitting website.
  3.  A Supplemental Water Quality Request Form was added as a tab. This form was added to comply with new requirements under the EPA’s finalized Clean Water Act 401 Water Quality Certification Rule. This form only applies to projects that are requesting a Water Quality Certification as part of Federal Permit for activities that are not covered by a General Permit (e.g. the RI General Permit issued by U.S. Army Corps of Engineers). The form requires the applicant to list additional permits applicable to the project, to include documentation of a pre-application meeting request, and to sign a newly required certification.



Tab for STW & WQC New or Modification Application Form

  1.  The informational text block at the top of the page was updated for clarity and to include information about, and a link to, the new Supplemental WQC Request Form.
  2.  In the Site & Project section, “RI Federal Aid Project #” was replaced with “RIDOT PSID #”. These numbers are only applicable to RIDOT projects.
  3.  In the Owner/Applicant section, “Contact Name of Owner’s Representative for Questions” was updated to “Name and Email of Owner’s Representative for Questions” to clarify that both name and email are requested.
  4.  In the Owner/Applicant section, “Email” was updated to “Owner’s Email” and was marked as required.
  5.  In the Professional section, “Email” was updated to “Professional’s Email”.
  6.  In the Permit History section, a link to the RIDEM Online Permit Search Tools was added.
  7.  In the Stormwater Construction Activity section, the box referring to applications submitted to RI CRMC was removed. This box is no longer relevant.
  8.  In the Stormwater Construction Activity section, in the box addressing discharges of stormwater to waters of the State, the reference to discharges within or to a Natural Heritage Area was removed. Discharges within or to a Natural Heritage Area are covered in the Appendix A Checklist.
  9.  The Water Quality Certification section was updated to clarify the different types of Federal Permits that require a WQC.
  10. The Submission Requirements section was updated to clarify that a Stormwater Management Plan includes a Stormwater Analysis and Drainage Report, a Soil Erosion and Sediment Control Plan, and a Post-Construction Operation and Maintenance Plan.
