[Owrinfo] RIPDES 2013 Construction General Permit - Reminder to All Applicants Applying to the Coastal Resources Management Council (CRMC)

Notice to All Applicants 

 

Please be advised that the RIDEM has received numerous inquiries into
whether or not a RIPDES Construction General Permit Notice of Intent
(NOI) needs to be submitted in order to obtain an authorization to
discharge under the 2013 RIPDES Construction General Permit, in
particular when the same applicant has also applied to the CRMC for an
Assent. 

 

In order to provide clarification on this question, the following would
apply:

 

1.	An NOI is not required to be submitted to the DEM if a CRMC
Assent has been issued. Per the 2013 RIPDES Construction General Permit
Part I.D.1.b, for new applications, the submittal of a NOI is only
required for construction activities that disturb greater than one (1)
acre that are not required to obtain a RIDEM Freshwater Wetlands Permit,
RIDEM Water Quality Certification, RIDEM UIC/Ground Permit, CRMC Assent
or QLP approval.

 

2.	Projects that have received a CRMC Assent are automatically
authorized to discharge under the RIPDES Construction General Permit
upon receipt of the CRMC Assent. This is outlined in the 2013 RIPDES
Construction General Permit Part I.D.3.c. which states: "Construction
activities that disturb an area equal to or greater than one (1) acre
that are required to obtain a RIDEM Freshwater Wetlands permit, RIDEM
Water Quality Certification, RIDEM UIC/Ground Permit, CRMC Assent or QLP
approval are authorized to discharge stormwater from construction
activities under the terms and conditions of the 2013 RIPDES
Construction General Permit upon receipt of one of the applicable
permits listed above."
