Highlights from EPA’s Review of MS4 Year 3 Annual Reports

Annual Reporting allows EPA, state authorities, and municipalities to track progress in meeting permit requirements and evaluate the effectiveness of local stormwater management programs. For those covered under the 2016 Massachusetts and 2017 New Hampshire Small MS4 General Permits, the Year 4 reporting period concludes at the end of this month. Below, we will share some results from EPA Region 1’s compliance monitoring of the Year 3 reports submitted last fall.

While many permittees made significant progress on the Year 3-specific requirements related to IDDE and post-construction stormwater management, there is room for improvement. In the IDDE arena, 66% of MA and 70% of NH permittees reported completing inspection and screening all outfalls and interconnections, excluding problem and excluded outfalls. Similarly, 74% of MA and 73% of NH permittees reported completing an updated outfall ranking based on the information collected during dry weather sampling results when needed. As we move past IDDE planning and into the implementation phases of outfall sampling and catchment investigation work, it is important to keep pace with requirements to ensure that illicit discharges are not undermining progress towards clean waterways.

EPA’s analysis identified a lower than expected rate of reported completion of the post-construction runoff regulatory requirement. As mentioned in the previous newsletter, 56% of MA and 63% of NH permittees reported updating and adopting their post-construction bylaw, ordinance, or other regulatory mechanism consistent with permit requirements. This legal mechanism is a critical tool for managing the impacts of development and EPA Region 1 will actively evaluate compliance with this requirement in Year 4.

Reported compliance with annual requirements varied, from strong performance on deployment of educational messages, recordkeeping and public participation, catch basin cleanings and street sweeping, and winter maintenance, to low reported performance on SWPPP implementation, inspecting permittee-owned treatment structures, and implementing MS4 infrastructure maintenance programs. 78% of MA and 83% of NH permittees reported successful completion of annual training to employees involved in IDDE programs.

This national survey assesses capital investment needed to meet the water quality goals of the Clean Water Act. Stormwater needs are included in this year’s survey and we are asking municipalities to contribute their data for an accurate assessment. This is an opportunity to showcase what significant need there is in our states for funding for stormwater management.
Eligible projects must be:

  *   Eligible for funding under the national CWSRF guidelines
  *   Unfunded as of January 1st, 2022 (i.e., construction has not started nor have external funds been committed to the project)
  *   Expected to be constructed within the CWNS 20-year planning horizon (2022-2041)
Accepted documents include capital improvement plans, asset management plans, integrated plans, or long-term stormwater plans. If your municipality does not have any of these planning documents, MassDEP has developed a state-specific approach that estimate cost needs for all MS4 municipalities. This approach relies on MS4 cost implementation estimates for all MS4 communities and estimates needs for $/lb Phosphorus removed for communities in the Mystic and Charles River Watershed to estimate stormwater needs. New Hampshire: New Hampshire has engaged a consulting firm, Comprehensive Environmental, Inc. (CEI), to gather and report eligible stormwater CWNS data to EPA. Municipalities should expect to hear from CEI to point them to their documentation and to discuss eligibility of documented projects. Once CEI has gathered available project and cost data for all municipalities that have it, they will use the EPA-approved New Hampshire State Specific Approach to generate costs for all remaining municipalities. This innovative method, first created by New Hampshire for the most recent CWNS in 2012, divides all state municipalities into five categories; calculates a rate per acre for each category based on municipalities within that category with eligible data; then applies that rate to the acreage in each remaining municipalities in that category. In this way, all municipalities in New Hampshire will have costs reported for the 2022 CWNS. Green infrastructure and nature-based solutions can protect water quality, build resiliency to heat waves, address flooding and other climate-exacerbated natural hazards, and improve overall quality of life in communities where they are implemented. Equitable community engagement and participation is key to developing nature-based solutions that fully benefit local residents.



This webinar will showcase how Massachusetts programs and organizations are supporting nature-based solutions at the local level and share lessons learned about effective strategies for equitable community engagement and participation in environmental projects. Let’s Talk About Heat Challenge to Raise Awareness of Extreme Heat Risks (Due 7/22/2022)
Extreme heat, when temperatures are much hotter than average over consecutive days, is an increasing problem for all parts of the United States. Extreme heat is linked to an increased risk of illness and death and has disproportionate impacts on people who are underserved and overburdened. People of color and people with lower incomes often live in neighborhoods with fewer trees and less greenery, which makes these areas hotter than wealthier areas of the same city. To help address this need, EPA and co-sponsors have launched the Let's Talk About Heat Challenge, a national competition to identify innovative and effective communication strategies that inform people of the risks of extreme heat and offer ways to keep safe during the hottest days. Submissions will include identification of and engagement with people known to be most susceptible to extreme heat risks, including but not limited to underserved and overburdened communities, and suitable messages and strategies to reach target audiences. NH DES Culvert Flood Risk Assistance Grants (Applications due 7/1/2022)

The New Hampshire Department of Environmental Services (NHDES) is accepting Culvert Flood Risk Assistance Grant applications for replacement of outdated, undersized, perched, and/or degraded culverts that are highly susceptible to flooding. The purpose of this funding opportunity is to encourage replacement of high-risk culverts with better designed crossings that meet improved structural and environmental design standards and flood resiliency criteria. Incorporating these standards into culvert replacement designs will reduce flood hazards and risks to public safety, including culvert failure and road washout. USDA Urban Agriculture Grants Program (Applications due 7/20/2022)

Department of Agriculture Urban Agriculture Grants support the development of urban agriculture and innovative production projects. EPA Brownfields Job Training Grant Program (Applications due 8/2/2022)

The EPA’s Brownfields Job Training grant program is a unique employment and training program. The grants allow nonprofit and other eligible organizations to recruit, train, and retain a local, skilled workforce by prioritizing unemployed and under-employed, including low-income individuals living in areas affected by solid and hazardous waste in environmental jobs. Since 1998, EPA has awarded 371 job training grants. With these grants, more than 19,000 individuals have completed training and over 14,700 individuals have been placed in careers related to land remediation and environmental health and safety.



The U.S. Environmental Protection Agency has announced that approximately $12 million in funding for environmental job training grants is now available under the Fiscal Year 2023 Brownfields Job Training Program. The funding available during this grant cycle comes from the historic $1.5 billion investment from President Biden’s Bipartisan Infrastructure Law. EPA anticipates awarding approximately 25 grants nationwide at amounts up to $500,000 per award. DOT Reconnecting Communities Pilot Discretionary Grant Program (Due Date To Be Announced)

The U.S. Department of Transportation (DOT) anticipates posting one or more Notices of Funding Opportunity (NOFOs) for the Reconnecting Communities Pilot Program (RCP) in Summer of 2022. The RCP was created under President Biden’s Bipartisan Infrastructure Law and will provide up to $1 billion over the next 5 years. The program’s funds can support planning, capital construction, and technical assistance to equitably and safely restore community connectivity through the removal, retrofit, mitigation, or replacement of eligible transportation infrastructure facilities that create barriers to mobility, access, or economic development.
